The U.S. Court of Appeals for the Ninth Circuit issued a significant ruling on February 10, 2015 on behalf of an RBBG client relating to the statute of limitations in California for claims under Title II of the Americans with Disabilities Act. Reversing the commonly-held assumption that the statute was two years, the court ruled that because the plaintiff’s ADA claim was against a public entity that the three year limitation period was applicable. The court also ruled that the district court had abused its discretion in dismissing the plaintiffs pro se claims without explanation.
