RBGG is one of 842 law firms nationwide that signed the Brief of Amici Curiae Law Firms filed on April 2, 2026 in support of Perkins Coie LLP, Jenner & Block LLP, Wilmer Cutler Pickering Hale and Dorr LLP, and Susman Godfrey LLP in their ongoing fight against the unconstitutional executive orders from President Trump targeting them.  The brief  was filed in the U.S. Court of Appeals for the District of Columbia Circuit and is attached here.    

On May 2, 2025 Judge Beryl Howell of the U.S. District Court for the District of Columbia ruled that the Executive Order targeting Perkins Coie was unconstitutional and directed the government not to enforce its terms.  The order is here.  The memorandum opinion is here.  On March 2, 2026 the Department of Justice announced that it would not appeal the ruling, but the Department reversed course a day later.

In a statement in reaction to the government’s reversal of course, Susman Godfrey said: “Yesterday evening, the administration told the court that it gave up and wouldn’t even try to defend its unconstitutional executive orders. Today, it reversed course. Regardless, Susman Godfrey will defend itself and the rule of law – without equivocation.”
