On August 11, 2025, a federal court in San Diego denied Defendants’ Motion for Partial Summary Judgment in Dunsmore et al. v. San Diego County Sheriff’s Department et al., No. 3:20-cv-00406-AJB-DDL, a class action lawsuit in the U.S. District Court for the Southern District of California, against the County of San Diego, San Diego County Sheriff’s Department, and San Diego County Probation Department over unconstitutional and unlawful conditions at the San Diego County Jail facilities.

RBGG’s Gay Grunfeld, lead counsel for Plaintiffs, commented: “Class counsel appreciates the care with which the Court’s 72 page decision analyzes the facts and law of this important case.  We look forward to trying the case in the near future and to obtaining injunctive relief that will reduce in-custody deaths and bring about real and lasting change in the San Diego County jail system.”

Plaintiff classes and subclasses prevailed on every claim.  The Court’s order is here.   Pre-trial procedures will begin 30 days after the Court’s ruling.  More information about the case, including court documents and expert reports can be found on the San Diego County Jail information page.
